These Terms and Conditions ("Agreement") are entered into between [COMPANY NAME SDN BHD (XXXXXX-X)], trading as MotorcyclesRide ("we", "us", "our"), and the person completing a booking ("you", "the Renter").
"Vehicle" means any motorcycle, scooter, or related conveyance rented under this Agreement. "Rental Period" means the period commencing at the time of pick-up and ending at the agreed return time. "Booking Confirmation" means the email or on-screen confirmation issued after a reservation is accepted.
Note to Renter: Where a placeholder appears in square brackets (e.g. [COMPANY NAME SDN BHD]), the operating entity has not yet completed its registration details. This Agreement is governed by the laws of Malaysia regardless.
By submitting a booking through this website — whether as a registered account holder or as a guest — you confirm that you have read, understood, and unconditionally accept these Terms and Conditions. If you do not agree, you must not proceed with a booking.
These Terms form the entire agreement between the parties and supersede any prior understanding or representation. No variation is binding unless confirmed in writing by us.
To rent a Vehicle you must, at the time of booking and throughout the Rental Period:
We reserve the right to refuse rental to any person who cannot produce satisfactory documentation at pick-up, in which case no refund of any booking fee will be due where the failure is attributable to the Renter.

A booking is only confirmed when you receive a Booking Confirmation from us. We reserve the right to decline or cancel any booking at our sole discretion.
Rental rates are quoted in Malaysian Ringgit (MYR) and are inclusive of applicable taxes unless otherwise stated. Duration-based pricing tiers are applied automatically at the time of booking based on the number of days selected.
Payment of the rental fee does not include the security deposit, which is collected separately at pick-up (see Clause 5). Rental fees are non-transferable between vehicles or renters.
A refundable security deposit is required at the time of pick-up. The deposit amount is specific to each Vehicle and is displayed on the Vehicle detail page prior to booking.
The deposit will be returned to you in full upon completion of the Rental Period, subject to:
Where damage or outstanding charges exceed the deposit amount, you remain liable for the balance and we reserve the right to recover that amount through any lawful means.
At pick-up, both parties will complete and sign a Vehicle Inspection Form documenting the condition of the Vehicle. Any pre-existing damage not recorded on the Form may be attributed to the Renter on return. You are responsible for reviewing the Form carefully before signing.
You confirm that you are satisfied with the condition of the Vehicle at the time of pick-up. Riding away constitutes acceptance of the Vehicle.
All Vehicles are maintained to a roadworthy standard before each rental. If you identify a mechanical concern at pick-up, notify us before departing — concerns raised after departure may not be upheld.
The Rental Period begins at pick-up and ends at the agreed return time stated in your Booking Confirmation.
Extensions: You may request an extension subject to availability. Extensions must be requested and confirmed in writing by us at least 24 hours before the original return time. Riding beyond the agreed return time without written confirmation from us constitutes a late return.
Late returns: Late returns will be charged at the applicable daily rate (or pro-rated portion thereof) for each additional day or part-day the Vehicle is retained. Significant late returns without prior notice may attract an additional administrative fee. We reserve the right to report the Vehicle as unlawfully retained to the relevant authorities if contact cannot be established within 24 hours of the agreed return time.
All Vehicles are provided with a full tank of fuel. You are required to return the Vehicle with a full tank. If the Vehicle is returned with less than a full tank, the cost of the missing fuel plus a refuelling service charge will be deducted from your security deposit.
You are responsible for using the correct fuel type as specified on the Vehicle or communicated at pick-up. Damage caused by incorrect fuelling is the Renter's full liability.
The following uses are strictly prohibited under any circumstances. Breach of any item in this clause will void any coverage or protection afforded under this Agreement, render the full security deposit non-refundable, and may expose you to additional civil and/or criminal liability.
9.1 Track, Racing, or Stunt Use
Using the Vehicle on any motorsport circuit, race track, closed road event, drag strip, or organised speed event is strictly prohibited. Stunt riding, wheelies, and any riding style that intentionally lifts either wheel from the road surface is likewise prohibited.
9.2 Off-road Riding
Riding the Vehicle on any unpaved surface — including dirt tracks, jungle trails, gravel paths, beaches, paddy fields, or any terrain not classified as a public road under Malaysian law — is strictly prohibited. All Vehicles are road-registered for on-road use only.
9.3 Cross-border Travel
Taking the Vehicle outside the borders of Malaysia — including into Singapore, Thailand, Indonesia, or any other jurisdiction — is strictly prohibited. Our Vehicles are insured for use within Malaysia only. Any cross-border use will immediately void this Agreement and transfer full liability for any loss, damage, or legal consequence to you.
9.4 Sub-renting and Unauthorised Riders
You may not sub-rent, lend, lease, or otherwise permit any person other than yourself to ride the Vehicle unless that person has been expressly authorised in writing by us prior to the Rental Period. Only the named Renter — as verified at pick-up — is authorised to ride. Any use by an unauthorised rider is a breach of this Agreement and will void all protections herein.
9.5 Commercial, Delivery, or Hire Use
Using the Vehicle for any commercial purpose — including but not limited to food or parcel delivery, e-hailing services, courier work, photography or filming hire, or any activity for which remuneration is received — is strictly prohibited. Vehicles are provided exclusively for private personal use.
9.6 Riding Under the Influence
Operating the Vehicle while under the influence of alcohol, drugs, prescription medication that impairs riding ability, or any other intoxicant is strictly prohibited and constitutes a criminal offence under the Road Transport Act 1987. You accept full liability for any consequences arising from riding under the influence, including fines, seizure of the Vehicle, accident damage, and personal injury to yourself or third parties.
9.7 Further Prohibited Conduct
In addition to the above, you must not: (a) use the Vehicle to tow any trailer, other vehicle, or load; (b) carry more passengers than the Vehicle is designed for; (c) use the Vehicle in contravention of any applicable road traffic law; (d) modify, tamper with, or attach any device to the Vehicle without our prior written consent; (e) use the Vehicle in connection with any criminal activity.
In the event of an accident, you must: (a) stop and render assistance as required by law; (b) notify the police immediately if required; (c) contact us by phone or WhatsApp as soon as practicable and in any event within 2 hours of the incident; (d) not admit liability, make any payment, or enter into any agreement with any third party on our behalf; (e) cooperate fully with any investigation.
In the event of a mechanical breakdown: contact us immediately. We will assess the situation remotely and, where the fault is verified as a pre-existing mechanical defect, we will make reasonable arrangements for recovery and/or a replacement Vehicle. Breakdowns attributable to rider misuse, fuel error, or accident are not covered and recovery costs will be charged to you.
Failure to notify us of an accident within the prescribed timeframe may result in forfeiture of the security deposit and full liability being transferred to you for all resulting costs.
You are responsible for the Vehicle throughout the Rental Period. You accept liability for:
Damage costs will be assessed against your security deposit in the first instance. You remain liable for any amount exceeding the deposit. Repair costs will be assessed at standard workshop rates and we reserve the right to charge for any loss of rental revenue during the repair period.
Our liability to you in respect of any claim arising out of or in connection with this Agreement is limited to the total rental fee paid by you for the relevant Rental Period. We are not liable for consequential, indirect, or special losses.
Our Vehicles carry road tax and third-party insurance as required under Malaysian law. This is the minimum statutory cover only — it covers third-party bodily injury and property damage but does not cover damage to the rented Vehicle itself or personal injury to the Renter.
We do not provide comprehensive or own-damage insurance as part of the rental fee. You are strongly encouraged to arrange your own personal accident or travel insurance covering motorcycle rental before your Rental Period commences.
Any use of the Vehicle in breach of Clause 9 (Prohibited Uses) will void the statutory third-party cover and render you solely liable for all resulting costs.

Cancellations must be submitted through the booking cancellation function on this website or by contacting us directly. Notice periods are calculated from the time we receive and confirm your cancellation.
We reserve the right to cancel a booking at any time due to circumstances beyond our reasonable control (including Vehicle unavailability due to accident, seizure, or natural disaster), in which case a full refund will be issued within 7 business days.
You agree to indemnify, defend, and hold harmless MotorcyclesRide and its directors, employees, and agents from and against any and all claims, damages, losses, fines, penalties, and legal costs arising out of or in connection with: (a) your use of the Vehicle during the Rental Period; (b) any breach by you of this Agreement; (c) any violation by you of any applicable law or regulation; or (d) any act or omission by any unauthorised rider permitted by you to use the Vehicle.
Your personal data is collected and processed in accordance with our Privacy Policy, which forms part of this Agreement. By making a booking you consent to the collection, use, and retention of your personal data as described therein, in compliance with the Personal Data Protection Act 2010 (Malaysia).
This Agreement is governed by and construed in accordance with the laws of Malaysia. Any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Malaysia.
Nothing in this Agreement excludes or limits any statutory rights you may have under Malaysian consumer protection legislation, including the Consumer Protection Act 1999.
We reserve the right to amend these Terms and Conditions at any time. The version in force at the date of your Booking Confirmation governs your rental. We recommend reviewing the current Terms before each booking. Material changes will be notified via the website homepage for a period of not less than 14 days before taking effect.

These Terms and Conditions were drafted as a starting point for a Malaysian motorcycle rental business. Clauses 11 (Liability Limitation), 12 (Insurance), and 14 (Indemnity) in particular should be reviewed by a qualified Malaysian lawyer before going live, as their enforceability may be subject to the Consumer Protection Act 1999 and the Contracts Act 1950.
